Captions Acceptable Use Policy

This Acceptable Use Policy applies to your use of our Services. Capitalized terms have the meaning stated in our Terms and Conditions.

You may not use the Services:

• beyond published parameters or use limitations;
• to violate or to encourage the violation of the legal rights of others;
• for any unlawful, invasive, infringing, defamatory or fraudulent purpose;
• for phishing or to generate spam or other forms of unsolicited communications;
• in a manner that burdens, disables or interferes with the Services, or that circumvents any aspect of the Services, including abuse protections;
• to misrepresent the provenance of generated content by claiming it was created solely by a human, or otherwise in order to deceive;
• as a means to participate in any disinformation campaign or to create deceptive comments or reviews; or
• In any way that suggests that Captions endorses you or your Output

You may not provide Input that:

• is inaccurate, offensive, unlawful, discriminatory or harmful;
• contains private or confidential information about another person;
• violates or infringes the intellectual property rights, rights of publicity, privacy rights or other rights of a third-party;
• violates or encourages any conduct that would violate our Agreement or otherwise create liability or violate any applicable local, state, national, or international law or regulation or would give rise to civil or criminal liability;
• is fraudulent, false, misleading or deceptive;
• impersonates or misrepresents your affiliation with any person or entity or contains or depicts any statements, remarks, or claims that do not reflect your honest views and experiences;
• is defamatory, obscene, pornographic, vulgar, offensive, unlawful, libelous, hateful, fraudulent, libelous, indecent, lewd, suggestive, abusive, or inflammatory;
• contains viruses, corrupted data, or other harmful, disruptive, or destructive files or content;
• is violent or threatening or encourages violence;
• promotes illegal activities or substances; or
• contains any protected health information as defined by the Health Insurance Portability and Accountability Act (HIPAA) of 1996, Pub. L. No. 104-191 except as permitted by an executed HIPAA BAA.

You may not generate Output that:

• facilitates, promotes or contains violent extremism or terrorism;
• facilitates, promotes or contains hatred or hate speech or that promotes discrimination;
• facilitates, promotes or contains bigotry, racism, hatred, harassment, or harm against any individual or group;
• threatens harm to another individual or group of people;
• is inflammatory, demeaning, dangerous, misleading, or excessively violent;
• facilitates illegal acts, including illegal gambling or gambling-adjacent activities;
• contains regulated or not age-appropriate goods or services including, but not limited to alcohol, tobacco, nicotine (including vaping products), psychoactive substances, firearms, gambling, contraceptives, sex toys, escort services, dating services, adult entertainment venues and similar subject matter;
• promotes the sale of or facilitates obtaining lethal weapons, explosives, and/or their related accessories (whether legal or not); or provides instructions on how to make or use weapons, explosives, poisons, or anything intended to be used to harm;
• is designed to harass or bully, intimidate, abuse or insult others;
• contains sexually explicit content such as pornography;
• facilitates or contains child sexual abuse or exploitation;
• relates to, or appears in our sole discretion to relate to or represent, individuals under the age of 18;
• contains profanity or vulgarity including by using symbols, emojis and the like;
• facilitates misleading, false or unsubstantiated claims including financial statements or statements related to the government or matters of public health;
• promotes or solicits endangering behaviors or activities to people or to animals or that glorifies, promotes, or normalizes suicide or other acts of physical self-harm;
• tracks or monitors people without their consent;
• makes automated decisions that have a material detrimental impact on individual rights without human supervision in high-risk domains;
• violates the intellectual property rights or other rights of others;
• is offensive, discriminatory, harmful, false, threatening, or misleading;
• is used as or part of non-fungible tokens (NFTs) or similar digital asset;
• will be used to create trademarks, design-marks, service-marks or other similar protected or registrable rights.
